Purpose
The purpose of processing personal data is the provision and operation of the website otsch.codes, as well as enabling users to get in touch.
In particular, personal data is collected and processed in the following areas:
Contact Form
When you use the contact form, the personal data you enter (e.g. name, email address, subject, and message) will be processed.
The purpose of processing is to enable contact as part of business initiation, customer acquisition or support – or simply to respond to your inquiry.
Processing is based on Art. 6(1)(b) GDPR for the performance of a contract or pre-contractual measures, or on my legitimate interest under Art. 6(1)(f) GDPR in efficient communication.
Your data will be stored only as long as necessary to process your request. In the event of a contract, the statutory retention periods apply.
Server Logs
When visiting the website, server logs are created. These include the IP address, date and time of access, the accessed page, and information about the browser and operating system used.
This data is processed to ensure the security and stability of our systems, for example to detect suspicious activity.
The processing is based on our legitimate interest in accordance with Art. 6(1)(f) GDPR, specifically in ensuring the security, stability, and optimization of our website.
Cookies
Cookies are small text files stored on your device when you visit a website, allowing the system to recognize you during subsequent visits and, where applicable, to collect information about your behavior on the site.
There are different categories of cookies:
- Strictly necessary cookies for the core functionality and security of a website.
- Performance and analytics cookies for statistical purposes and user behavior analysis.
- Third-party tracking and marketing cookies which may be used to identify and track you across other websites.
otsch.codes only uses cookies that are necessary for the core functionality and security of the site. Specifically, a so-called session cookie is used to identify you as the same user across multiple page visits, for example to protect the contact form from spam bots.
Data Security
Protecting your personal data is important to me. I implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk. These include, among others, encrypted data transmission (TLS), access controls, role-based permissions, regular security updates, and backups.
My systems are designed to prevent unauthorized access to personal data as well as accidental or unlawful alteration, loss, or disclosure.
Disclosure to Third Parties and Recipients
To fulfill my contractual or legal obligations, the purpose of data processing, or when there is a legitimate interest in business transactions involving third parties, it may be necessary to transmit your data to third parties. Possible recipients may include authorities, courts, tax advisors, banks, lawyers, insurers, IT service providers, and hosting companies. The forwarding of your data is exclusively based on the GDPR.
In general, your personal data will not be transferred to recipients in third countries. If I need to transfer your data to a country outside the EEA, it will only be to countries for which the EU Commission has decided that they have an adequate level of data protection, or I will take measures to ensure that all recipients have an adequate level of data protection, including the use of standard contract clauses (2010/87/EC and/or 2004/915/EC).
Rights of the Data Subject
When I process your personal data, you are considered a data subject under the GDPR. In this case, you can exercise your data subject rights. These rights include:
- Right to be informed about your stored personal data
- Right to rectification
- Right to be forgotten
- Right to restrict processing
- Right to object to processing
- Right to withdraw consent
- Right to data portability
- Right to file a complaint with a supervisory authority
To exercise one or more of these rights, you can contact me by email at office@otsch.codes.
If you believe that my processing of your personal data violates applicable data protection law or your data protection rights have otherwise been violated, you have the option to lodge a complaint with the competent supervisory authority. In Austria, the competent authority for this purpose is the Datenschutzbehörde (https://www.dsb.gv.at/).
